When we process personal information on behalf of a client in the course of providing HR consulting or related services, we may do so pursuant to our agreement with that client and their instructions, subject to applicable law.

Through your interactions with us and use of our Website, Esser HR Consulting collects and may transmit personal data that you voluntarily provide to us (“Personal Data”). Personal Data that we collect and transmit includes:

In addition, when we provide HR consulting, compliance, training, or related services to clients, we may receive personal information about our clients’ employees, applicants, contractors, former employees, dependents, beneficiaries, or other workforce participants. This information may be provided by the client, the individual, a service provider, a government agency, or another authorized source.
Depending on the services requested, workforce-related information may include contact information, employment history, job title, compensation and payroll information, performance or disciplinary information, investigation-related information, demographic or equal employment opportunity information, government identification numbers, tax information, and other information reasonably necessary to provide HR-related services.
Sensitive Employment-Related Information
Because HR consulting may involve sensitive employment information, we may process information such as Social Security numbers, driver’s license or other government identification numbers, bank or direct deposit information, wage and payroll data, benefits data, medical leave information, disability or accommodation information, workers’ compensation information, and similar information when necessary to provide services, comply with legal obligations, or act as instructed by a client.
We use sensitive employment-related information only for authorized business, legal, and service-related purposes. We limit access to personnel, contractors, vendors, professional advisors, and other parties with a legitimate need to know or as otherwise permitted or required by law.

This section applies to individuals who apply to work for Esser HR Consulting. It is separate from workforce information that Esser HR Consulting may receive from clients while providing HR consulting or related services.

We may disclose your Personal Data to monitor and analyze the use of our Website.

To link your information to a third-party Social Network such as Facebook, Twitter, LinkedIn, or YouTube through the use of widgets that allow for certain interactive social functions such as a “share this” button (This sharing is subject to each Social Network’s own privacy policy and terms of use. We do not control those Social Networks or your profiles on those services)
We also may use and disclose Personal Data (1) upon lawful request, in response to legal process, and when required to comply with laws, (2) to enforce our agreements, corporate policies, and terms of use or (3) to protect the rights, property or safety of our employees, agents, customers, and other third-parties, (4) to investigate, prevent or take action regarding suspected or actual illegal activities or to assist government enforcement agencies; or (5) to investigate and defend against any third-party claims or allegations.
For HR consulting and related services, we may disclose workforce-related personal information to the client that engaged us, to client-authorized systems or vendors, cloud hosting, email, CRM, analytics, and other service providers, and to government agencies, courts, regulators, or other parties when required or permitted by law or authorized by the client.
We expect service providers that process personal information for us to use that information only as necessary to provide services, maintain appropriate safeguards, and comply with applicable confidentiality and data protection obligations.
Promotional Communications
Esser HR Consulting may use your Personal Data to connect you with our newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.
We do not use client workforce information for unrelated promotional communications unless permitted by the client, the individual, or applicable law.
Why We Collect Your Personal Data
Most of the Personal Data we collect is provided to us directly by you so that we can bring our service and products to you. Your Personal Data is collected for our legitimate business interests or those of our service providers as outlined below:

Client Workforce Information
When we receive personal information about a client’s employees, applicants, contractors, former employees, dependents, or other workforce participants, we generally process that information as part of the services we provide to the client. The client is responsible for providing any notices or obtaining any consents required from its workforce unless our agreement with the client states otherwise.
Individuals whose information was provided to us by a client should generally contact that client directly with questions, access requests, correction requests, or other privacy requests. We may refer such requests to the client or process them in accordance with the client’s instructions and applicable law.

The security of your Personal Data is important to us. Esser HR Consulting takes reasonable administrative, technical, and physical safeguards to protect your information from unauthorized access, disclosure, alteration, or destruction.

We are not responsible for the privacy practices of third parties and encourage you to read the privacy statements of any third-party website you are directed to. Complaints, claims, concerns, or questions regarding third-party practices should be directed to the third-party.

Where personal information is processed on behalf of a client, we may notify and coordinate with the client so that legal notice obligations can be handled appropriately.

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, provide services, comply with legal obligations, resolve disputes, enforce agreements, support audits, and maintain business records.
When personal information is no longer required, we take reasonable steps to securely destroy, erase, de-identify, or otherwise dispose of it in a manner designed to make the information unreadable or undecipherable, subject to applicable retention obligations and client instructions.
Age of Consent
Our Website is not intended for use by those under the age of 18, nor is it targeted to those under the age of 18. If you use our Website, you hereby represent and warrant that you are at least 18 years of age. We do not knowingly collect Personal Data from those under the age of 18. If you are under the age of 18, we ask that you do not provide any information on our Website through any of its features, and promptly discontinue use of our website.
If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.

To protect privacy and security, we may need to verify your identity before responding to a request. If your request relates to information we process on behalf of a client, we may direct you to the client or respond in accordance with the client’s instructions and applicable law.
Personal Data We Sell or Use for a Business Purpose
Esser HR Consulting does not sell the Personal Data we collect and will not sell it without providing you with the right to opt-out. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
For purposes of California privacy law, the more relevant disclosure is whether personal information has been shared with third parties for their own direct marketing purposes. Please see the California Privacy Rights section below.
California Privacy Rights
California residents may have additional rights under California law. This section is intended to address California requirements applicable to website operators and businesses handling personal information, including California’s Shine the Light law and related privacy notice requirements in effect during the 2016 timeframe.
California’s Shine the Light Law
California Civil Code § 1798.83 permits users that are residents of California to request the following information regarding our disclosure of your Personal Data to third parties for those third parties’ direct marketing purposes:
A list of certain categories of personal information that we have disclosed to certain third parties for their direct marketing purposes during the immediately preceding calendar year
The identity of certain third parties that received personal information from us for their direct marketing purposes during that calendar year
Where the nature of the third parties’ business is not reasonably determinable, examples of the products or services marketed (if we have that information).

“Do Not Track”
Do Not Track is a preference you can set in your web browser to inform websites you do not want to be tracked. You can enable or disable DNT by visiting the preferences or settings page of your web browser. Currently, given the lack of uniform implementation across browsers, our Website does not respond to “do not track” signals.
Some third-party services used on the Website may collect information about your online activities over time and across different websites. We do not control how third-party services respond to Do Not Track signals.
